1. Introduction
Welcome to PrecisionCc. These Terms and Conditions govern your use of our website and the services we provide. By accessing our website or engaging our services, you agree to be bound by these terms. If you do not agree with any part of these terms, you must not use our website or services.
2. Services
PrecisionCc provides specialized copywriting, content strategy, and compliance review services ("Services") for clients in the financial sector. The specific scope of services for each client engagement will be detailed in a separate Service Agreement.
3. Client Responsibilities
To facilitate the effective delivery of our Services, you (the "Client") agree to:
- Provide timely access to necessary materials, personnel, and information required for the project.
- Provide a designated point of contact for all communications and approvals.
- Review all deliverables and provide feedback or approval in a timely manner.
- Ensure that all information provided to PrecisionCc is accurate and that you have the legal right to use and share it.
- The Client retains ultimate responsibility for the final compliance approval of all content. While PrecisionCc provides expert, compliance-aware guidance, we are not a law firm and do not provide legal advice. The Client is responsible for obtaining final sign-off from their own internal or external legal and compliance departments.
3A. Communication Policy
All client support, project discussions, and deliverable reviews are conducted asynchronously via our chat system. We do not schedule phone calls or in-person meetings. You will receive timely responses and a full transcript of every interaction.
4. Payment Terms
Fees for our Services will be outlined in the Service Agreement. Unless otherwise agreed, payment terms are 50% upfront to initiate work and 50% upon final delivery. For our Precision Content Audit service, payment of the full project fee is required upfront. All payments are due within 15 days of the invoice date. Late payments may incur interest charges.
5. Intellectual Property
Upon full payment of all fees due, the Client will own the full intellectual property rights to the final, approved deliverables created by PrecisionCc for the specific engagement. PrecisionCc retains the right to use the work for our own portfolio and marketing purposes, in a manner that respects client confidentiality.
All methodologies, processes, and proprietary tools used by PrecisionCc remain our exclusive intellectual property.
6. Confidentiality
PrecisionCc agrees to treat all non-public information provided by the Client as confidential. We will not disclose this information to any third party without the Client's prior written consent, except as required by law.
7. Disclaimer of Warranties; Limitation of Liability & Indemnification
Our services are provided on an "as is" basis. PrecisionCc provides expert strategic guidance on marketing and compliance-aware communication; however, we are not a law firm and do not provide legal advice.
The Client acknowledges that they are solely and ultimately responsible for obtaining final approval from their own internal or external legal and compliance departments for any content we deliver.
Under no circumstances shall PrecisionCc be liable for any direct, indirect, special, incidental, or consequential damages, including but not limited to, lost profits, regulatory fines, or legal fees incurred by the Client as a result of their use of our services or content. The entire liability of PrecisionCc for any claim arising out of your use of our services or content will not exceed the total fees paid by the Client for the specific engagement in question.
The Client agrees to indemnify, defend, and hold harmless PrecisionCc and its founder from and against any and all claims, liabilities, damages, and expenses arising from the Client's use, publication, or distribution of the delivered content.
8. Termination
Either party may terminate a Service Agreement with 30 days' written notice. In the event of termination by the Client, the Client agrees to pay for all work completed up to the termination date. PrecisionCc may terminate an agreement immediately if the Client breaches these terms or fails to make timely payments.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. We will notify you of any changes by posting the new terms on this page. Your continued use of our website or services after any such changes constitutes your acceptance of the new terms.
